Boscovich Rent (hereinafter referred to as the Lessor) rents a vehicle to the Lessee, whose details are provided on the front side of the vehicle rental agreement, under the following conditions:
1. The Lessee confirms their agreement with the following provisions of the Vehicle Rental Agreement by signing it:
They accept the rental prices and other conditions as per the valid price list as an integral part of this contract.
They possess a valid driver's license for at least 2 years and are at least 21/25 years old.
They receive the vehicle in good working condition with all necessary accessories and documents.
They are obliged to return the rented vehicle within the agreed period or earlier at the request of the Lessor.
They must request the Lessor’s consent to extend the rental period at least 24 hours before the vehicle’s return deadline.
They must immediately stop driving if the odometer malfunctions and notify the Lessor as soon as possible.
They must take care of and properly maintain the vehicle during the rental period.
They must not use the rented vehicle under the influence of alcohol or other psychoactive substances, for illegal purposes, for driver training, commercial transportation of passengers or goods, towing or transporting other vehicles, trailers, or their parts, or for participation in motorsport events.
They must use the rented vehicle exclusively for personal needs and must not lend or sublease it to third parties.
They must operate the vehicle themselves or authorize another person in the rental contract, provided that the additional driver is listed in the contract, holds a valid driver’s license, and is at least 21/25 years old.
They must not overload the vehicle beyond the prescribed weight limit.
They must not use the rented vehicle abroad without prior consent from the Lessor.
They must not modify any parts, assemblies, or other components of the vehicle without the Lessor’s consent.
They are responsible for fuel expenses.
2. If the Lessee fails to comply with the conditions specified in Article 1, they must compensate the Lessor for any and all damages incurred, as determined by the Lessor.
3. The Lessor will reimburse the Lessee for oil and routine vehicle maintenance costs upon presentation of a payment receipt (this does not include vehicle washing costs during the rental period).
4. The Lessee is responsible for paying all fines and traffic violations incurred due to improper use of the vehicle, including parking fines.
5. The rental price includes third-party liability insurance, subject to the legally established limits.
6. The rental price does not cover the following risks:
Damage to the rented vehicle outside of a registered traffic accident (e.g., damage to the vehicle while parked, etc.). In case of damage in a parking lot or traffic, the Lessee must pay for the full damage to the rented vehicle.
Theft of the vehicle during the rental period – the Lessee must pay the full value of the rented vehicle if it is lost or stolen.
7. The Lessee is responsible for damages to the rented vehicle, as well as for any losses resulting from the vehicle being out of service (idle time during repairs). The compensation for idle time is calculated as the daily rental rate according to the valid price list.
8. Collision Damage Waiver (CDW) Insurance
The Lessee may obtain insurance coverage for damages caused by the vehicle being out of service (idle time) by purchasing and paying for CDW insurance.
The Lessee is required to report all vehicle damages to the Lessor during the rental period, regardless of whether they resulted from a traffic accident or not, to complete an accident report at the Lessor's office, and to immediately report the accident and damage to the competent police authority at the scene where the incident occurred to obtain a police report.
If a traffic accident or damage is not reported to the police, the Lessee must pay the full damage amount, regardless of having purchased CDW insurance.
Regardless of CDW insurance, the Lessee must provide a written statement in the accident report.
9. Theft/Loss Protection Insurance – THW
The Lessee has the option to insure the vehicle against theft or loss during the rental period by purchasing and paying for THW insurance.
In the event of theft or loss of the vehicle during the rental period, the Lessee must immediately report the incident to both the Lessor and the police in the location where the theft/loss occurred and complete a loss/theft report at the Lessor's office.
If the theft or disappearance of the vehicle is not reported to the police, the Lessee must pay the full value of the vehicle, even if they have purchased THW insurance.
Regardless of THW insurance, the Lessee is required to provide a written statement along with the loss/theft report.
10. Regardless of any purchased damage waiver, the Lessee is responsible for:
Damage caused while they or an authorized driver operated the vehicle under the influence of drugs or alcohol,
Damage caused intentionally or due to gross negligence and reckless driving,
Damage occurring while the driver did not possess a valid driver’s license,
Theft if the vehicle was not locked at the time of the incident.
11. The Lessee agrees to protect the Lessor’s and its insurance company’s interests in case of an accident by:
Recording the names and addresses of all involved parties and witnesses,
Not abandoning the damaged vehicle before securing and moving it from the accident site,
Immediately calling and waiting for the police in case of major damage or injury (even when fault is obvious),
Submitting a written accident report to the nearest Lessor’s office.
12. If the Lessee fails to comply with Sections 10 and 11, they bear full responsibility for all consequences and damages incurred by the Lessor.
13. Passenger Insurance – PAI
The Lessee can insure the driver and all passengers against disability or death resulting from a traffic accident by purchasing Passenger Accident Insurance (PAI).
Personal insurance for the driver and passengers is void if the Lessee drives recklessly or under the influence of drugs or alcohol.
14. The Lessor is not liable for the loss or damage of personal belongings or goods stored in/on the rented vehicle.
15. The Lessor is not responsible for any damages incurred by the Lessee due to vehicle malfunctions during use and/or delays in vehicle delivery.
16. Any modifications to this agreement are only valid if confirmed in writing by both parties.
17. If the Lessee pays with a credit card, they authorize the Lessor, by signing the original contract, to charge all rental costs to the issuing credit card company or bank.
18. If a foreign currency is used for payment, the exchange rate will be determined solely by the Lessor.
19. In case of disputes arising from this contract, the parties agree that the competent court in Podgorica shall have jurisdiction.
The vehicle can be rented by a driver who is at least 20 years old.
The minimum rental period is 24 hours.
Prices are stated in euros and include VAT.
Mileage is unlimited.
The price includes mandatory third-party liability insurance.
Comprehensive insurance (CASCO) does not cover damages under 200 euros, damages caused under the influence of alcohol, drugs, or other psychoactive substances, driving without a valid or revoked driver's license, or situations where there are more passengers in the vehicle than the registered number of seats. Regardless of additional comprehensive insurance, the client is obligated to compensate Boscovich Rent – rent-a-car company for any damages.
In case of a traffic accident or vehicle breakdown, the renter must wait next to the vehicle for police officers to arrive and draft an official report on the damage, as well as for a representative from Boscovich Rent to retrieve the vehicle. If the renter fails to comply with these obligations and thus causes damage to Boscovich Rent, they must compensate for the full amount of the damage, including lost profits.
Additional comprehensive insurance does not cover damage to tires, parts of the vehicle below the license plates, minor scratches requiring polishing, or the loss of keys, vehicle documents, tools, or first aid kits. The renter must cover these costs in full.
The renter must pay a fee of €2000 for the loss of keys or vehicle documents.
Fuel costs are borne by the renter unless the vehicle is returned with the same fuel level as when it was received.
If the renter does not return the same fuel level, the fuel charge is calculated based on the distance traveled at a rate of 0.15€/km. Boscovich Rent reserves the right to increase this rate depending on fuel prices at gas stations.
Late vehicle returns are subject to an additional charge of 1/4 of the daily rental rate per hour of delay.
Boscovich Rent reserves the right to modify daily rental rates.
All mutual rights and obligations are clearly defined in the Rental Agreement, which must be signed upon taking possession of the vehicle.
